Automated mobile communication record preservation for US federal government agencies

Without automatic capture and archiving, government staff are often left to decide what is or isn’t considered a federal record and are at liberty to delete government business related text and chat messages from their government issued mobile devices.

As widely reported in the press, a high ranking US Department of Homeland Security official recently admitted to routinely deleting text messages from his government issued mobile phone because he did not deem them to be federal records.

What are the regulatory requirements?
The Federal Records Act of 2016 (FRA) outlines what is classified as a federal record and how these should be preserved and archived for eDiscovery:

“Federal records are all recorded information, regardless of form or characteristics, made or received by a Federal agency under Federal law or in connection with the transaction of public business. Federal records must be preserved by an agency – as evidence of the organization, functions, policies, decisions, procedures, operations or other activities of the United States Government or because of the informational value of the data in them – until they are authorized for disposal as temporary records or for transfer to the National Archives as permanent records.”

CellTrust SL2 helps government agencies meet FRA requirements
US federal government agencies can now provide staff with compliant mobile communication – where text and chat messages are automatically captured and archived on both personal/Bring Your Own Device (BYOD) or government issued mobile phones.

CellTrust SL2 Enterprise Capture provides a secure messaging solution with automated capture and archive capabilities built in. Captured data is stored securely and easily retrievable for eDiscovery.

Federal agency staff will no longer need to self-determine what constitutes a federal record, and federal agencies are much better equipped to efficiently and cost-effectively meet Freedom of Information Act (FOIA) requests as required by law in support of transparency.
